Civil Court Lawyer in UAE

Most civil disputes in the UAE are decided by the paperwork, not the argument. By the time a case reaches a hearing, the pleadings have been filed, the expert has reported and the evidential record is closed. A civil court lawyer earns their fee in the weeks before any of that happens.

TrustedLawyers.ae acts for companies, investors, contractors, landlords and individuals in civil claims across the Emirates. We handle contract and debt claims, property and construction disputes, compensation claims and shareholder disagreements — before the onshore courts, and before the DIFC and ADGM Courts where the contract points there. Whether you are pursuing a claim or defending one, the first question we answer is not how strong your case feels, but what you can prove and what it will cost to prove it.

UAE civil law framework 2026: Civil Transactions Law and Civil Procedure Law

What Counts as a Civil Case Under UAE Law

A civil case is a private dispute over rights and obligations — money owed, property withheld, a contract broken, harm caused. The state does not prosecute it. You bring it, you prove it, and you enforce the outcome.

The Civil Code that now governs your contract

The UAE replaced its Civil Code in 2026. Federal Decree-Law No. 25 of 2025, the new Civil Transactions Law, came into force on 1 June 2026 and repealed Federal Law No. 5 of 1985 in full. The core principles survived, but the drafting was modernized, the article numbering changed, and new concepts were introduced — including express duties of good faith in pre-contractual negotiations, clearer rules on the governing law chosen by the parties, and refined treatment of civil liability and compensation.

This matters more than it sounds. A contract signed in 2019 and breached in 2026 sits across two codes, and non-retroactivity rules decide which provisions apply to which part of the dispute. Pleadings that quote 1985 article numbers now point at different provisions. A competent civil case lawyer UAE side will identify the governing text before drafting a single line of claim.

Civil, commercial and criminal — where the lines fall

Not every grievance is a civil claim. A bounced cheque can support a civil debt action. A labor complaint begins with the Ministry of Human Resources and Emiratisation, not the civil court. Rental disputes in Dubai go to the Rental Disputes Centre. Filing in the wrong forum costs months and, occasionally, the claim itself.

Onshore courts, DIFC and ADGM

Onshore UAE courts compared with the DIFC Courts and ADGM Courts

The UAE contains three civil justice systems. The onshore courts apply UAE civil law and operate in Arabic. The DIFC Courts and the ADGM Courts are common-law jurisdictions operating in English, with their own procedural rules and their own judges. Which one hears your case usually depends on a jurisdiction clause agreed years earlier, sometimes on where the defendant is established, and occasionally on an opt-in agreement made after the dispute arose.

Civil Cases We Take to Court

Contract disputes and debt recovery

Unpaid invoices, terminated supply agreements, failed payment undertakings and disputed variations. We send the legal notice, build the documentary record, and file where negotiation stalls. Where the debtor is dissipating assets, we apply for precautionary attachment before the claim is heard rather than after.

Property and real estate disputes

Off-plan delays, handover defects, service charge disputes, sale and purchase agreement terminations, and co-ownership disagreements. Property claims turn on registration records and contractual milestones, so the file is usually won on documents.

Construction and contractor claims

Payment claims, extension of time and delay disputes, defect claims and termination disputes. These cases are decided in large part by the court-appointed engineering expert, which is why we invest heavily in the submissions made to that expert rather than saving the argument for the judge.

Civil liability and compensation

Claims for harm caused by negligence, breach of duty or wrongful acts — including professional negligence, damage to property, and losses caused by a third party. The new Civil Code refined how compensation is assessed, so the quantification of loss deserves closer attention than it once did.

Shareholder, partnership and agency disputes

Deadlock between partners, exclusion from management, disputed profit entitlements, and terminated commercial agency arrangements. These claims often run alongside corporate filings, so the litigation strategy and the corporate steps have to be sequenced together.

Inheritance and estate matters

Estate distribution, disputed wills, and claims between heirs. The 2026 procedural amendments allow specialized judicial circuits to be constituted for estate and inheritance matters, which has changed how these cases are managed.

When to instruct a civil lawyer in UAE — warning signs checklist

When You Need a Civil Lawyer in UAE

People usually call a lawyer one step later than they should. The moments below are the ones where early instruction changes the outcome rather than merely tidying the file:

  • A legal notice has arrived and a response deadline is running against you.
  • Invoices are unpaid and the debtor has stopped answering correspondence.
  • A cheque has been dishonored or a payment undertaking has failed.
  • A contract has been terminated and a damages claim is being prepared against you.
  • A limitation period may be approaching and the claim risks becoming time-barred.
  • You need assets attached or a travel ban imposed before the debtor moves funds offshore.
  • You have a judgment in hand and nothing has actually been recovered.

Waiting is rarely neutral. Evidence goes cold, witnesses leave the country, and settlement leverage evaporates once the other side realizes no action is coming.

05

The Structure of the UAE Civil Courts

Onshore civil litigation runs through three tiers. The Court of First Instance registers the claim, receives the evidence and gives judgment. The Court of Appeal rehears the dispute on both facts and law. The Court of Cassation — or the Federal Supreme Court, in the Emirates within the federal judicial system — reviews points of law only, and only where the case meets the cassation threshold.

Dubai, Abu Dhabi and Ras Al Khaimah operate their own local judicial authorities with their own Courts of Cassation. Sharjah, Ajman, Umm Al Quwain and Fujairah sit within the federal system. The tier structure is the same; the filing practice, timelines and fee scales are not.

How a Civil Case Moves Through the Courts

  1. Step 1 — Amicable settlement
Many civil claims must pass through conciliation before a court will register them. Federal Decree-Law No. 40 of 2023 governs mediation and conciliation in civil and commercial disputes nationally. In Dubai, Law No. 18 of 2021 as amended by Law No. 9 of 2025 goes further: the courts are expressly barred from registering a claim that falls within mandatory conciliation unless it has first been put to the Centre for Amicable Settlement of Disputes or another authorized body. A settlement reached at this stage becomes enforceable once it carries the executory formula.
  2. Step 2 — Registration and fees
The claim is filed with supporting documents and a legally certified Arabic translation of anything in another language. Court fees are calculated on the value of the claim and are subject to a cap that varies by Emirate.
  3. Step 3 — Case Management Office
Before the case reaches a judge, the Case Management Office handles service, sets the schedule and supervises the exchange of memoranda. This is where most cases are actually built. Since the 2026 amendments tightened the formalities for later stages, the record created here increasingly determines what can be argued on appeal.
  4. Step 4 — The court expert
In accounting, engineering, valuation and technical disputes the court appoints an expert whose report carries substantial weight. Sessions before the expert are, in practice, the decisive hearings in most commercial civil cases.
  5. Step 5 — Judgment
The Court of First Instance issues a reasoned judgment on the claim, the counterclaim, interest where awarded, and costs.
  6. Step 6 — Appeal and cassation
An appeal must be filed within the statutory period by a formal statement of appeal, lodged at the Case Management Office or electronically. Federal Decree-Law No. 22 of 2025, in force since 1 January 2026, tightened these formal requirements and narrowed the scope of cassation review — which means procedural precision at first instance now decides whether an appeal survives at all.
  7. Step 7 — Execution
A judgment is not money. The execution judge attaches bank accounts, salaries, shares and property, and can impose travel bans. Cases are frequently won and then abandoned at this stage; we treat execution as part of the mandate, not a separate afterthought.

What Changed for Civil Claims in 2026

Two reforms landed within six months of each other, and both affect live disputes:

  • 1 January 2026 — Federal Decree-Law No. 22 of 2025 amended the Civil Procedure Law (Federal Decree-Law No. 42 of 2022). It allows specialized judicial circuits, including for estate matters, strengthens the courts’ engagement with expert evidence, imposes stricter formal requirements on appeals and narrows the scope of cassation review.
  • 1 June 2026 — Federal Decree-Law No. 25 of 2025, the new Civil Transactions Law, replaced the 1985 Civil Code in full, with restructured and renumbered articles, express pre-contractual good faith duties and clarified rules on governing law and compensation.

The practical consequence is that a great deal of the UAE civil litigation material published before 2026 — including template pleadings and article citations circulating in the market — is now out of date. Getting the applicable code and the correct article right is no longer a drafting nicety; it is a threshold issue.

Civil court attorney UAE rights of audience: advocate versus legal consultant

Who Is Allowed to Argue Your Case

Under Federal Decree-Law No. 34 of 2022 on the advocacy and legal consultancy professions, the profession is split in two. Advocates are entered on the roll and hold rights of audience before the courts. Legal consultants may advise, draft and negotiate, but cannot plead your case at a hearing.

This is worth checking before you sign an engagement letter. A firm can advise you competently for months and still be unable to stand up in the Court of First Instance on your behalf. Ask directly whether the person handling your file is an advocate with rights of audience before the court that will hear your case, and who will actually appear.

09

Court, Arbitration or Conciliation

The forum is often decided by a clause signed long before the dispute. Where you still have a choice, the trade-offs are real: court litigation is open to any claim and gives you two further tiers of review, but it is public and runs in Arabic onshore. Arbitration is private and flexible, but it needs a valid agreement and offers almost no appeal. If your contract contains an arbitration clause, speak to our arbitration lawyer team instead — filing in court despite a binding clause usually ends in the claim being stayed or dismissed.

What a Civil Case Costs in the UAE

Three costs sit behind every civil claim: the court fee, calculated on the claim value and capped at an Emirate level; the expert fee, deposited with the court where an expert is appointed; and legal fees, charged as a fixed stage fee, an hourly rate or a blended arrangement depending on how predictable the matter is.

A court may award a contribution towards legal costs, but recovery is generally partial. That is why we give a written view on the merits, the likely timeline and the realistic net recovery before anything is filed. If the arithmetic does not work, we will tell you that rather than open a file.

Best civil lawyer in UAE — how TrustedLawyers.ae runs a civil file

Why Clients Choose TrustedLawyers.ae

Choosing the best civil lawyer in UAE is not about who sounds most confident in the first meeting. It is about who does the unglamorous work well. What we hold ourselves to:

  • Advocates with rights of audience before the courts where your case will actually be heard.
  • Claims drafted under the correct Civil Code for the date of your contract and the date of the breach.
  • Expert-stage submissions treated as the main event, not a formality.
  • Arabic pleadings prepared alongside English-language reporting your board can act on.
  • The mandate carried through execution, so a judgment turns into recovered money.
  • A written merits, timeline and cost position before you commit.

Frequently Asked Questions

What does a civil court lawyer do in the UAE?+

A civil court lawyer advises on the merits of a private dispute, sends and answers legal notices, prepares and files pleadings, manages the evidence and the court expert stage, appears at hearings, and enforces the resulting judgment through the execution court.

Which law governs my civil claim now?+

Substantive rights are governed by Federal Decree-Law No. 25 of 2025, the Civil Transactions Law, in force since 1 June 2026. Procedure is governed by Federal Decree-Law No. 42 of 2022 as amended by Federal Decree-Law No. 22 of 2025. Where a contract predates June 2026, non-retroactivity rules determine which code applies to which issue.

Do I have to try conciliation before going to court?+

For many civil claims, yes. Federal Decree-Law No. 40 of 2023 governs mediation and conciliation nationally, and in Dubai the courts cannot register a claim falling within mandatory conciliation unless it has first been referred to the Centre for Amicable Settlement of Disputes or another authorized body. Urgent applications and certain categories are excluded.

How long does a civil case take in the UAE?+

It depends on the tier and the complexity. A straightforward first-instance debt claim moves considerably faster than a construction dispute requiring an engineering expert. Appeal and cassation add further time. We give a timeline estimate specific to your matter before filing.

Can I file a civil case in English?+

Not before the onshore courts. Proceedings are conducted in Arabic and foreign-language documents require legally certified translation. The DIFC Courts and the ADGM Courts operate in English.

Can a foreign lawyer represent me in a UAE court?+

Only advocates registered on the roll hold rights of audience before the onshore courts. Federal Decree-Law No. 34 of 2022 allows narrow routes for foreign lawyers to appear, subject to strict conditions. Legal consultants may advise but cannot plead.

What can I do if the other party is moving money out of the country?+

You can apply for precautionary attachment over bank accounts and assets, and in appropriate cases seek a travel ban. These applications are most effective when made early, before assets are dissipated.

I have a judgment but no money. What now?+

The matter moves to the execution court, which can attach accounts, salaries, shares and real property. Execution is a distinct stage with its own procedure, and it is where many otherwise successful claims stall.

Can a foreign judgment be enforced in the UAE?+

Foreign judgments can be recognized and enforced subject to statutory conditions and any applicable treaty. The route depends on the country of origin and whether reciprocity applies.

Is a bounced cheque a civil or a criminal matter?+

A dishonored cheque can found a civil claim for the debt, and separate regulatory consequences may follow. The civil recovery route and any other exposure should be assessed together rather than in isolation.

What is the limitation period for a civil claim?+

It depends on the type of claim and on which Civil Code governs it, and the 2025 Code clarified several of these periods. Because a missed limitation period ends a claim outright, it should be checked against your specific facts at the outset rather than assumed.

How do I choose between litigation and arbitration?+

If your contract contains a valid arbitration clause, the choice has largely been made and filing in court risks dismissal. Where no clause exists, the decision turns on confidentiality, cost, speed, the need for a right of appeal, and where the counterparty holds assets.

Do you handle both claimants and defendants?+

Yes. A significant part of our civil work is defense — answering notices, challenging jurisdiction, contesting expert findings and reducing exposure.

How do I start?+

Send the contract, any legal notice and the correspondence. We review the position and come back with the merits, the likely timeline and the cost of acting.
