Criminal Court Defence Lawyer & Attorney in UAE

Criminal Defence Lawyer in UAE

If you are reading this because a complaint has been filed, a summons has arrived, or someone has been detained, the most useful thing to know is that the earliest stage matters most. A criminal case in the UAE is largely built before it reaches a courtroom. Statements are taken and recorded in Arabic, the file is assembled by the police, and the Public Prosecution decides whether to charge, release or detain. By the time the matter is referred to court, most of what the judge will read has already been written.

TrustedLawyers.ae defends individuals and companies in criminal matters across the Emirates — from attendance at the police station and the Public Prosecution through trial, appeal and cassation, and on to the consequences that follow, including travel bans and attached civil claims. We act for residents, visitors and people who are currently outside the country.

Why the Early Stage Decides Most Cases

Three things happen quickly, and each is difficult to undo afterwards.

First, statements. What you say at the police station is recorded in Arabic and forms part of the file for the life of the case. People routinely sign documents they have not fully understood because they want to be cooperative and want to go home. A signed statement is not easily withdrawn later.

Second, the prosecution decision. The Public Prosecution alone decides whether to bring charges, and it decides on release, bail and detention. This is the point at which representation has the greatest effect on the shape of the case.

Third, the options narrow. Dismissal, bail and statutory settlement are all live possibilities early on. Once a case has been referred to court, the room to resolve it without a contested trial shrinks considerably.

This is not an argument for panic. It is an argument for getting a lawyer involved before the first interview rather than after the third.

UAE criminal law framework: Crimes and Penalties Law and Criminal Procedure Law

The Laws That Govern a Criminal Case in the UAE

The Crimes and Penalties Law

Federal Decree-Law No. 31 of 2021 replaced the 1987 Penal Code with effect from 2 January 2022 and defines offences and penalties across the UAE. It has been amended since, most recently in 2025, with changes that tightened penalties in certain categories of serious offence and introduced structured assessment of convicted offenders in the closing period of a sentence.

The Criminal Procedure Law

Federal Decree-Law No. 38 of 2022 came into force on 1 March 2023 and was amended by Federal Decree-Law No. 45 of 2023. It governs everything procedural: arrest, investigation, detention, bail, referral, trial, appeal and enforcement. It also introduced several features that matter directly to a defence — a Minor Felony Court sitting with a single judge, an express right to challenge an order extending detention, provisions on precautionary measures over assets, provision for remote hearings, and a statutory criminal settlement regime.

Specialist statutes

Many cases are charged under specific laws rather than the general code: the cybercrime and rumours legislation, the narcotics law (amended in 2025 to expand treatment and rehabilitation routes alongside tougher penalties for unlawful dispensing), anti-money laundering legislation, and the traffic law. The statute under which a matter is charged affects the available defences and the sentencing range, so identifying it correctly is an early priority.

04

Your Rights If You Are Accused

The Criminal Procedure Law sets out protections for a person under investigation. In practice they are only worth what you know about them:

  • To be told the charge against you.
  • To have a lawyer present during questioning.
  • To remain silent rather than incriminate yourself.
  • To an interpreter where you do not speak Arabic, so that you understand what you are signing.
  • To apply for bail, and to renew that application as the case develops.
  • To challenge an order extending your detention.
  • To present evidence, call witnesses, challenge the prosecution case and appeal a conviction.

Two of these are exercised far less often than they should be. Asking for a lawyer before answering questions is not treated as an admission of anything. Neither is asking for an interpreter, or refusing to sign a document you cannot read.

UAE criminal case process from complaint to enforcement

How a Criminal Case Moves Through the System

Complaint and police stage

A matter usually begins with a complaint at a police station or, in some categories, directly with the Public Prosecution. Statements are taken from all parties. Custody at this stage is subject to short statutory periods, and any extension requires authorisation.

The Public Prosecution

The file passes to the Public Prosecution, which has sole authority to bring a criminal action. It interrogates the accused, decides on bail or continued detention, and decides whether to refer the matter to court or close it. Bail applications are made here first, in writing and with supporting guarantees, and a refusal can be challenged.

Referral and trial

The case is referred to the court with jurisdiction over the classification of the offence. Hearings are held with statutory notice periods and are generally public unless the court orders otherwise. The defence presents evidence, examines witnesses, challenges the prosecution case and may request expert reports.

Appeal, cassation and enforcement

A conviction can be appealed, with the appeal court rehearing the matter on the facts and the law. Cassation reviews points of law only, where the case meets the threshold. Appeal deadlines in criminal matters are short and are strictly applied, which is why an appeal is assessed the day a judgment is delivered rather than the week after.

06

Which Court Hears Your Case

The classification of the offence determines the court. Lesser offences are heard in the Misdemeanour Court. The Criminal Procedure Law introduced a Minor Felony Court sitting with a single judge for felonies punishable by temporary imprisonment. More serious matters go before the Felony Court. Above these sit the Court of Appeal and the Court of Cassation, or the Federal Supreme Court in the Emirates within the federal judicial system.

Classification is not always obvious from the allegation, and it is occasionally arguable. Whether a matter is charged as a misdemeanour or a felony changes the court, the procedure and the exposure.

Criminal settlement under the UAE Criminal Procedure Law

Criminal Settlement: The Route Many People Never Hear About

The Criminal Procedure Law contains a statutory settlement regime that can bring proceedings to an end without a contested trial. It is one of the most significant defence developments in recent UAE criminal practice, and it remains poorly understood outside the profession.

It is not available for everything. Matters involving qisas or diya, and offences committed against juveniles, are excluded. For felonies, availability is limited to those punishable by temporary imprisonment and those connected with misdemeanours. Within those limits, settlement can resolve a matter far faster and with far less exposure than a trial.

Timing is the whole point. The scope to explore settlement is widest early and narrows as the case progresses. A defence that only starts thinking about resolution once the trial date is set has usually left the best option behind.

Cases We Defend

Fraud, breach of trust and financial offences

Allegations of fraud, misappropriation, breach of trust and forgery, frequently arising out of a commercial relationship that has broken down. These often run alongside a civil or commercial claim, and the two need to be handled together — our commercial court lawyer team deals with the recovery side.

Cybercrime and online speech

Defamation and insult online, unauthorised access, misuse of data, impersonation and circulation of material. The cybercrime legislation is broader than most residents assume, and messages sent in a private group have founded prosecutions.

Assault and public order

Altercations, assault allegations and public order matters, including cases where the person charged was the one who was struck first.

Narcotics offences

Possession, consumption and trafficking allegations, including cases involving prescription medication carried into the country. The 2025 amendments expanded treatment and rehabilitation routes, which can be relevant to how a first-time matter is approached.

Cheque and debt-related allegations

Most insufficient-funds cheque matters are now handled civilly rather than criminally, but bad-faith conduct can still carry criminal exposure. Establishing which side of that line a case falls on is the first step.

Company officer liability

Where a criminal allegation is directed at a manager, director or authorised signatory arising from the conduct of a business, including regulatory and anti-money laundering matters.

Traffic offences causing injury or death

Serious traffic matters, which carry criminal consequences alongside diya and civil compensation exposure.

Travel bans, passport retention and asset measures in UAE criminal cases

Travel Bans, Passport Retention and Asset Measures

Restrictions can apply long before any trial. A travel ban can be issued during the investigation stage, and a passport may be retained while a case is open. The Criminal Procedure Law also gives the Public Prosecution powers to trace, locate and freeze assets connected to a suspected offence and to appoint a custodian over them.

These measures are tied to the underlying case. They are addressed by dealing with the case itself and, where appropriate, by applying to lift or vary the restriction through the file. If you have been told you cannot leave the country, the priority is establishing what the ban is attached to, because that determines what can be done about it.

10

If You Are Outside the UAE

A case does not pause because you have left the country. Proceedings can continue and a judgment can be given in your absence, with consequences that surface when you next travel. We are regularly instructed by people who left the UAE without knowing a complaint had been filed and only discovered it later.

You do not have to be present for us to act. A legalised power of attorney allows us to review the file, establish the actual position, deal with the Public Prosecution and the court, and advise on what returning would involve. Where an international notice is involved, that is addressed through the proper channels. The mistake to avoid is flying back to find out what the position is.

Appeal, cassation, compensation and deportation after a UAE conviction

After a Judgment

Conviction is frequently not the end of the matter. Appeal deadlines are short and strictly applied, so the decision whether to appeal is made immediately. A victim may attach a civil compensation claim to the criminal proceedings rather than bringing a separate action, and where that has happened the quantum is contested as part of the same file — our civil court lawyer team handles the compensation side where it runs separately.

Certain convictions carry deportation consequences. That exposure is part of the defence rather than an administrative afterthought, and it shapes decisions taken much earlier in the case — including whether to contest a matter or resolve it.

Frequently Asked Questions

Can I have a lawyer with me at the police station?+

Yes. The Criminal Procedure Law provides for a lawyer to be present during questioning. Asking for one is not treated as an admission and does not prejudice your position.

Do I have to sign a statement I cannot read?+

No. Statements are recorded in Arabic, and you are entitled to an interpreter so that you understand what is written before you sign. Signing a document you have not understood is one of the most common and most damaging errors made in UAE criminal cases.

Who decides whether I am charged?+

The Public Prosecution has sole authority to bring a criminal action. It interrogates the accused, decides on bail or detention, and decides whether to refer the matter to court or close it.

How does bail work in the UAE?+

Provisional release may be granted by the Public Prosecution or, later, by the court. An application is made in writing with supporting guarantees, and it can be renewed as the case develops. A refusal can be challenged.

Can I challenge being kept in detention?+

Yes. The Criminal Procedure Law gives an accused the right to challenge an order extending detention, and grievances against orders made in your absence are subject to short deadlines, so they should be raised immediately.

What is criminal settlement and does it apply to me?+

It is a statutory mechanism under the Criminal Procedure Law that can end proceedings without a contested trial. It is not available for matters involving qisas or diya or offences against juveniles, and for felonies it is limited to those punishable by temporary imprisonment and connected misdemeanours. Whether it is available depends on how your matter is charged.

Why can I not leave the country?+

A travel ban can be issued during the investigation stage, and a passport may be retained while a case is open. The ban is attached to a specific case, so the first step is establishing which one and what stage it has reached.

What happens if I am outside the UAE and a case has been filed?+

The case can proceed and a judgment can be given in your absence. You can instruct a lawyer by legalised power of attorney to establish the position and act on the file without travelling. Returning before you know the position is the risk worth avoiding.

Is a bounced cheque still a criminal matter?+

In the ordinary insufficient-funds case, no — it is handled through civil execution. Bad-faith conduct such as stopping payment without cause or closing the account before presentation can still carry criminal consequences.

Can a company or its managers be prosecuted?+

Yes. Legal persons can bear criminal liability, and allegations are frequently directed at managers, directors and authorised signatories in connection with the conduct of a business.

Will a conviction mean deportation?+

Certain convictions carry deportation consequences. Because that exposure shapes decisions taken much earlier in a case, it should be assessed at the outset rather than after judgment.

How long do I have to appeal?+

Criminal appeal periods are short and are applied strictly. The safe approach is to treat the decision as one to be taken on the day judgment is delivered, not later in the week.

Can the victim claim compensation in the criminal case?+

Yes. A civil claim for harm can be attached to the criminal proceedings rather than brought as a separate action, and the amount is contested as part of the same matter.

What should I do first?+

Write down what happened while it is fresh, keep every document and message, do not sign anything you have not understood, and call us before the next interview rather than after it.
