Immigration Lawyer & Attorney in UAE

01 — Overview

You need an immigration lawyer when the system has said no.

Most UAE visa work is administrative, and a typing centre or a company PRO handles it perfectly well. You need an immigration lawyer when the system has said no: an entry ban you cannot explain, a deportation order, an absconding report filed by a former employer, a travel ban attached to a case you did not know existed, or a residence application refused without a stated reason.

TrustedLawyers.ae acts for individuals and employers in exactly those situations. The work begins in the same place every time, and it is the step most people skip: establishing what is actually recorded against the file, and which authority put it there. Until that is known, every submission is a guess, and a submission filed with the wrong body does not fail quickly. It simply sits.

UAE immigration authorities: ICP, GDRFA, MOHRE and the courts
Authorities

Four Authorities, One File

There is no single immigration department in the UAE, and the divisions matter because each body can only lift what it imposed.

The Federal Authority for Identity, Citizenship, Customs and Port Security, generally referred to as the ICP, administers the federal immigration system under Federal Decree-Law No. 29 of 2021 and its executive regulations in Cabinet Resolution No. 65 of 2022.

The General Directorate of Residency and Foreigners Affairs, the GDRFA, handles residency in Dubai, including Dubai-issued visas and administrative deportation orders made there.

The Ministry of Human Resources and Emiratisation, MOHRE, controls work permits, labour bans and absconding reports. Its decisions can block employment even where immigration status is clear.

The courts and the Public Prosecution impose travel bans and order judicial deportation, and neither can be undone by an immigration application.

A client who tells us “I have a ban” is usually describing one of four different things, imposed by different bodies, with different remedies. Separating them is the first hour of the work and it saves months.

Restrictions

Four Restrictions People Routinely Confuse

RestrictionWho imposes itWhat it stopsHow it is addressed
Labour banMOHREA new work permit. It does not by itself stop you entering the country.Petition to MOHRE, usually with evidence about how the employment ended
Immigration or entry banICP or GDRFAEntry, and any new visa or residence applicationGrievance to the issuing authority, with escalation where a grievance is refused
Travel banThe courts or the Public ProsecutionLeaving the country while a case is liveSettling or securing the underlying claim, or challenging the ban itself
Absconding reportThe employer, through MOHREStatus, sponsorship transfers, and often triggers a banWithdrawal by the employer, or a labour complaint establishing the real position

These are checked in different places. Status and absconding through the ICP or GDRFA channels, fines through the same, and travel bans through the courts and the Public Prosecution. Running all of them before you book a flight removes most airport surprises, and it is the single most useful thing an individual can do without a lawyer.

Administrative and judicial deportation in the UAE compared
Deportation

Two Kinds of Deportation, and Why It Matters

This is the distinction that changes everything about how a case is run, and it is misunderstood constantly.

Administrative deportation

Ordered by the immigration authority rather than by a judge, typically following a status or immigration violation. The published route is an application to the authority that issued it, in the Emirate concerned, and where a grievance is refused practitioners commonly escalate through the administrative courts. Because that escalation route is not published as a single official step, it should be confirmed against current practice rather than assumed.

Judicial deportation

Ordered by a court as part of a criminal judgment. It is challenged through the criminal appeal, not through an immigration application, and the timeline is the appeal timeline, not an administrative one. Where the conviction is reduced or overturned, the deportation element can fall with it. If your removal follows a criminal case, treat it as criminal work first, and our criminal defence lawyer team leads it with the immigration team alongside.

A deportation order is normally accompanied by a re-entry ban, and its length varies considerably with the ground. Immigration violations sit at the shorter end; criminal and security grounds at the longer, and in serious cases the ban is not time-limited at all. Anyone telling you that every deportation carries the same ban, or that every ban can be cleared, is not describing the system accurately.

Services

What an Immigration Lawyer Actually Does

  • Establishing what is recorded against a file, including obtaining the reason behind a blocked status where that is not visible to the individual.
  • Entry and visa ban grievances, and escalation where a grievance is refused.
  • Deportation challenges, whether administrative or through the criminal appeal.
  • Absconding report removal, by negotiated withdrawal or through a labour complaint.
  • Travel ban applications, including where the underlying claim can be secured rather than paid in full.
  • Appeals and resubmissions after a refused residence or golden residence application.
  • Sponsorship disputes, including where a sponsor will not cancel or transfer a visa.
  • Regularising status where someone is out of status and exposed to accruing fines.
  • Urgent assistance at the airport, in secondary inspection or in immigration detention.

What we do not do is promise outcomes. Some bans come off in weeks. Some do not come off at all, and the honest advice in those cases is about what to do next rather than what to file.

How an absconding report is filed and removed in the UAE
Employment status

The Absconding Report

An absconding report is filed by an employer to record that a worker has left employment without following the proper process. It takes an employer very little effort, and it has serious consequences: status is frozen, a sponsorship transfer becomes impossible, and an entry ban commonly follows.

Not every report is well founded. Some are filed in error, some after a dispute, and some as leverage. There are two realistic routes out. The employer can withdraw the report, which is often achievable once the position is put properly and in writing. Alternatively, where the employee has a genuine labour complaint, establishing the true reason the employment ended can resolve the report and the status together.

The variable that matters most is time. A report addressed within weeks is a different matter from one addressed after a year abroad, when the employer has moved on and the evidence has gone. If a report has been filed against you, do not wait to see whether it causes a problem.

07
Overstay

Overstay, Fines and Regularising Status

Being out of status is a solvable problem, and it gets harder the longer it runs. Fines accrue daily and are collected before departure, which is why people discover them at the check-in desk rather than in advance. Longer overstays can require a separate exit permit before departure is allowed at all, and an unresolved overstay is weighed against every future application you make.

A word of caution about published guidance, including ours. The grace period and fine rules were revised more than once during 2026, and relief measures were introduced and then wound down within the same year. Numbers quoted in articles, including numbers quoted confidently, go stale quickly. Anything you are about to act on should be verified against the ICP or GDRFA position on the day, and where you are already in difficulty, verified by someone who will look at your actual file rather than at a table.

Amnesty and fine-waiver programmes do appear periodically, and they are genuinely valuable when they are open. They are also announced with limited notice and closed on schedule. If one is running when you read this, the useful response is to move on it rather than to wait.

UAE residence visa routes and the common reasons for refusal
Residence routes

Residence Routes, and Where They Fail

The UAE residence framework is broad and mostly accessible. Golden residence for investors and outstanding talent, green residence for self-sponsored skilled workers and freelancers, employment sponsorship, family sponsorship, remote work residence and student routes all sit under Federal Decree-Law No. 29 of 2021 and Cabinet Resolution No. 65 of 2022. For a straightforward application, you do not need a lawyer.

Legal input earns its cost in four situations:

  • The application has already been refused, and the refusal does not explain itself. Most refusals turn on evidence not meeting the standard rather than on the applicant being ineligible, and a resubmission that does not identify the actual defect simply fails again.
  • There is history on the file. An old overstay, a previous ban, a closed criminal file or a dispute with a former sponsor changes what needs to be addressed and how.
  • The route is genuinely complex. Nomination and talent categories, structures where investment sits across several entities, or family arrangements that do not fit the standard form.
  • A security or background clearance has caused the refusal. These are the hardest cases, the options are limited, and you should be told that plainly rather than sold an application.

Family sponsorship deserves a specific mention because it produces more avoidable refusals than any other category: income thresholds that have been revised, accommodation evidence, medical and clearance requirements, and non-standard family structures.

Where sponsorship of a dependant also raises guardianship or documentation questions, that side is handled by our family court lawyer team.

When an Immigration Problem Is Really Another Case

A large proportion of immigration instructions have a non-immigration cause sitting behind them, and the ban is only the symptom.

Debt is the most common. A travel ban attached to a civil claim or an unpaid judgment does not lift because you explain your circumstances to the immigration authority; it lifts when the claim is settled, secured or successfully challenged, which is civil court lawyer work. Criminal files, including old ones the client believed were closed, are the second. Labour disputes are the third, and they are frequently the fastest to resolve because the absconding report and the underlying complaint move together.

This is why we ask early whether there is any case, complaint or unpaid obligation anywhere in your history in the UAE, including matters you consider finished. It is a much better conversation to have at instruction than after a submission has been refused.

09
Process

How an Immigration Matter Runs

  1. Status check and reason
We establish what is flagged and, where possible, the reason behind it. A blocked file tells the individual very little; the underlying reason is what determines the remedy.
  2. Identifying the authority and the remedy
Which body imposed the restriction, whether it can lift it, and what form the application takes: a MOHRE petition, a grievance to the ICP or GDRFA, a court application, or a criminal appeal.
  3. Clearing the underlying cause
Very few restrictions lift while their cause is outstanding. Fines paid and clearance obtained, a debt settled or secured, an employment position resolved. This stage usually determines whether the rest succeeds.
  4. Submission
The grievance or application is prepared with the supporting evidence and, where relevant, the personal circumstances that properly bear on the decision: length of residence, family in the country, employment, and conduct since the violation. Documents originating abroad need attestation and legally certified Arabic translation, and that should be started early.
  5. Follow-up and decision
Immigration files do not chase themselves. We track the submission, respond to requests, and obtain the outcome in writing rather than by report.
  6. Verification
The step most often skipped. Once a restriction is said to be lifted, it should be verified on the system before you book travel or commit to a job offer. Records do not always update when the decision is made.

When to instruct an immigration lawyer in UAE — warning signs
When to instruct

When to Instruct an Immigration Lawyer in UAE

  • You have been refused entry, or told at the airport that your file is blocked.
  • A deportation order has been issued against you or a member of your family.
  • A former employer has filed an absconding report you believe is wrong.
  • You cannot leave the country and have discovered a case you did not know about.
  • A residence or golden residence application has been refused without a clear reason.
  • You are out of status and the fines are still accruing.
  • A sponsor will not cancel or transfer your visa.
  • You are an employer facing permit refusals or a compliance problem affecting your staff.

Choosing counsel

Choosing Who Acts for You

Immigration distress attracts people who should be avoided, and the cost of the wrong adviser here is higher than in most areas of law, because a badly framed submission can make the file worse. Three warnings are worth stating plainly.

Nobody can guarantee that a ban will be lifted. Outcomes on immigration grievances are discretionary. An outcome promised in advance, particularly for a fixed fee, is a warning sign rather than a service.

Any suggestion that a decision can be influenced by payment beyond official fees should end the conversation immediately, and it puts you at risk as well as the person offering it.

Ask for the scope in writing: what will be filed, with which authority, on what grounds, and what happens if it is refused. An adviser who will not put that in writing is not going to do it.

You should also expect to be told when there is nothing to file. That answer is worth paying for, because the alternative is a series of applications that cannot succeed.

Costs & trust

What Immigration Work Costs

Costs fall into official fees and charges, which are set by the relevant authority and are not negotiable; the cost of clearing the underlying cause, which is usually the largest number where a debt or a fine sits behind the restriction; and legal fees, which can be fixed for a defined piece of work such as a status check, a grievance or an absconding removal, and staged for matters running through appeal.

We quote after the status check rather than before it, because the status check is what tells anyone honestly what the matter involves. Where the position is weak, we will say so, and we will not open a file to produce a submission that has no realistic prospect.

Why Clients Choose TrustedLawyers.ae

Choosing the best immigration lawyer in UAE has less to do with confidence than with accuracy. What we hold ourselves to:

  • The reason on the file is established before anything is submitted.
  • Applications go to the authority that can actually grant them.
  • Underlying causes are cleared first, because restrictions rarely lift while their cause is live.
  • Where a criminal, civil or labour case sits behind the restriction, both matters are run together.
  • Prospects are given honestly, including when the answer is that nothing can usefully be filed.
  • Attestation and legal translation begin at instruction so submissions are not delayed by documents.
  • Outcomes are obtained in writing and verified on the system before you are told a matter is closed.
  • Advocates with rights of audience where a court application or an appeal is required.

Where We Act

We handle immigration matters across Dubai, Abu Dhabi, Sharjah, Ajman, Umm Al Quwain, Ras Al Khaimah and Fujairah, before the ICP and the GDRFA, with MOHRE, and before the courts where an appeal or a court application is required. Clients who are outside the country and cannot return are handled remotely: status checks, powers of attorney, submissions and hearings managed without you needing to travel.

Frequently Asked Questions

What does an immigration lawyer do in the UAE?+

Work that goes beyond processing an application: establishing what is recorded against a file, lifting entry and visa bans, challenging deportation orders, removing absconding reports, addressing travel bans, and appealing refused residence applications. Routine visa filing rarely needs a lawyer at all.

What is the difference between a labour ban and an immigration ban?+

A labour ban is imposed by MOHRE and blocks a new work permit; it does not by itself prevent you entering the country. An immigration or entry ban is imposed by the ICP or the GDRFA and blocks entry and residence. They have separate remedies and separate authorities.

What is the difference between a travel ban and an entry ban?+

A travel ban stops you leaving the UAE and is normally attached to a court or prosecution matter such as a debt or a criminal case. An entry ban stops you coming in. Resolving one does nothing for the other.

How do I find out why I am banned?+

Status and absconding can be checked through the ICP or GDRFA channels, fines through the same, and travel bans through the courts and the Public Prosecution. Where the underlying reason is not visible to you, a lawyer can attend the relevant office to obtain the reason recorded against the file.

Can a deportation order be challenged?+

Yes, but the route depends on the type. An administrative deportation is challenged by grievance to the issuing authority, with escalation where it is refused. A judicial deportation forms part of a criminal judgment and is challenged through the criminal appeal, not through an immigration application.

Does deportation always mean a permanent entry ban?+

No. A deportation order is normally accompanied by a re-entry ban, but its length varies with the ground. Immigration violations sit at the shorter end and serious criminal or security grounds at the longer, with some not time-limited. The ground determines the answer.

Can an absconding report be removed?+

Often, yes. The two realistic routes are withdrawal by the employer, which is frequently achievable once the position is put properly, or a labour complaint that establishes the real reason the employment ended. Acting quickly makes a substantial difference.

How much are overstay fines and how long is the grace period?+

Both were revised more than once during 2026 and vary by visa type, so any figure quoted in an article may already be out of date. Check the current position through the ICP or GDRFA before acting, and take advice on your own file if you are already out of status.

Is there an amnesty running at the moment?+

Amnesty and fine-waiver programmes are announced periodically and run for limited windows. There is no permanent scheme. If one is open it is worth moving quickly, and the position should be checked against current ICP announcements rather than assumed.

My residence application was refused and no reason was given. What now?+

Most refusals turn on evidence falling short of the required standard rather than on ineligibility. The useful step is identifying the actual defect before resubmitting, because a fresh application with the same material usually produces the same result.

Can I be banned because of a debt?+

A debt can produce a travel ban preventing you from leaving while the matter is live, and unpaid obligations can affect future applications. The remedy is dealing with the underlying claim by settlement, security or challenge, rather than an immigration submission.

My employer will not cancel my visa. What can I do?+

This is a sponsorship dispute and there are routes through MOHRE and, where necessary, the courts. It should not be left, because status continues to run and the exposure grows while the dispute is unresolved.

Can you guarantee my ban will be lifted?+

No, and neither can anyone else. Grievance outcomes are discretionary. What can be done is to identify the correct authority and remedy, clear the underlying cause and present the strongest properly evidenced case. Anyone guaranteeing a result in advance should be treated with caution.

Can you help if I am already outside the UAE?+

Yes. Much of this work is done for clients who cannot return, using a power of attorney. Status checks, grievances and submissions can all be handled without you being in the country.

How do I start?+

Send us your passport details, any decision, notice or stamp you have received, and a short account of what happened and what you were told. We begin with a status check and come back with the real position, the route available and the cost.
