Litigation Lawyer & Attorney in UAE

01 — Overview

Litigation Lawyer in UAE

Litigation in the UAE onshore courts does not work the way litigation works in most of the places our clients come from. There is no disclosure obligation on the other side. There is no trial in the sense of oral argument and cross-examination. The person who effectively decides the facts in a commercial case is usually not the judge but a court-appointed expert. And correspondence you marked "without prejudice" can be put in front of the court.

None of that makes the system unfair. It makes it different, and the difference rewards preparation heavily. TrustedLawyers.ae runs claims and defences before the onshore courts across the Emirates, and the way we approach a case reflects where it is actually won: in the documents assembled at the start and in the submissions made to the expert in the middle, rather than in a hearing at the end.

Procedure

Five Ways UAE Litigation Differs

The case is fought in writing

Proceedings run through exchanged memoranda rather than oral argument. Lawyers do not generally address the court at length, and hearings are short and procedural. What persuades is what is written and filed.

There is no discovery

You cannot demand that your opponent hand over their file. Each party produces its own evidence. A court can order production of specific documents that are essential to resolving the dispute, but broad requests and fishing expeditions are not entertained. This has a practical consequence people underestimate: if the document that proves your case is only in the other side’s possession, you have a problem that needs solving strategically at the outset, not at trial.

The court-appointed expert does the fact-finding

In most commercial and technical disputes the court appoints an expert who examines the documents, meets the parties and reports. That report carries very substantial weight. It is the closest thing this system has to a trial, and it is dealt with in its own section below.

Witnesses are the exception

Oral testimony is admitted in defined circumstances rather than as a matter of course, and documentary evidence carries more weight than what a witness says. A case built on what people will say tends to lose to a case built on what was written at the time.

Language and translation

The onshore courts operate in Arabic. Foreign-language documents are filed with legally certified translation, and the quality of that translation matters, because the version the court reads is the version that counts.

There is a sixth point that deserves its own warning. Written communications between parties are not privileged in the way common-law lawyers expect, and marking a letter "without prejudice" does not reliably keep it out. Assume that anything you put in writing to a counterparty can end up in a memorandum.

03
Court hierarchy

The Court Structure

Onshore proceedings run through a defined sequence, and each stage does something different.

  • The Court of First Instance decides the facts and the merits. This is where the memoranda are exchanged and where an expert is normally appointed.
  • The Court of Appeal reconsiders facts and law. New claims not arising from the original proceedings are not admitted, although the original claim can be adjusted in defined ways.
  • The Court of Cassation reviews questions of law, including jurisdictional and procedural error. It is not a third hearing on the facts, and treating it as one is a common and expensive mistake.
  • The Execution Court is a separate stage with its own file, and it is where a judgment becomes money.

This page is about how litigation works. Which court and which body of law applies to your particular dispute is a separate question: commercial and B2B claims are covered on our commercial court lawyer page and civil claims on our civil court lawyer page.

The role of the court-appointed expert in UAE litigation
Expert stage

The Court-Appointed Expert Is the Real Trial

If you take one thing from this page, take this. In the majority of commercial, construction, accounting and technical disputes, the court appoints an expert, and the expert’s report is the single most influential document in the case. Cases are frequently decided in substance at this stage, long before judgment.

Appointment and scope

The court may appoint an expert on its own initiative or on a party’s application, generally from the official register. The appointment order defines the questions the expert must answer and the steps they may take. The expert derives their authority from that order and cannot go beyond it.

What the expert can and cannot do

The expert investigates facts and technical matters. They do not decide legal issues, interpret the law or determine liability. Those remain for the court. A common tactical error is arguing law to the expert and facts to the court, when the effective approach is close to the reverse.

The stage most parties waste

Parties file documents and submissions directly with the expert, attend meetings, and comment on a draft before the final report is filed. That comment window is a genuine opportunity to correct a misunderstanding while it is still cheap to correct. Once the final report is with the court, dislodging it is materially harder. We treat expert-stage submissions with the same preparation that a common-law firm would give to a trial, because functionally that is what this stage is.

05
Evidence

What Actually Persuades a UAE Court

Evidence in civil and commercial proceedings is governed by the federal Law of Evidence, with expert practice supported by separate legislation regulating experts before the judicial authorities. Four practical points follow.

  • Contemporaneous documents win. Contracts, purchase orders, delivery notes, statements of account and the correspondence trail carry more weight than any account given after the dispute began.
  • Electronic records are recognised, which matters because most commercial dealing now happens by email and messaging. Authenticity has to be capable of being established, so how records are collected and preserved is part of the case.
  • Oral testimony is limited and admitted in defined circumstances. Where it is available it is supplementary, not central.
  • Party-appointed expert opinions can be filed as supporting material, but they do not displace the court-appointed expert. Use them to inform the expert, not to compete with them.

One more time, because it costs clients real money: settlement correspondence between the parties is not protected the way it is in common-law jurisdictions. Negotiate in writing on the assumption that the letter may be read by a judge.

UAE Civil Procedure Law amendments in force from January 2026
2026 amendments

What Changed on 1 January 2026

Federal Decree-Law No. 22 of 2025 amended the Civil Procedure Law with effect from 1 January 2026. Four changes matter to anyone litigating now.

Appeals must be complete when filed

An appeal is now filed by a statement of appeal, at the Case Management Office or electronically, setting out the grounds with the supporting documents attached. An incomplete filing risks being inadmissible. The practice of lodging a placeholder appeal to stop the clock and completing it later no longer works. If a judgment has gone against you, the appeal has to be built inside the deadline rather than after it.

Cassation review was widened

The scope of cassation was extended so that decisions issued by the Courts of Appeal can be challenged, not only judgments. That is a broadening of review rather than a narrowing, and it gives litigants a route against procedural decisions that previously sat outside the appeal system.

The Public Prosecutor gained a petition power

The Public Prosecutor may petition the Court of Cassation in defined circumstances, including where the parties have let the appeal period lapse, waived their right or had an appeal ruled inadmissible. The petition is examined in chambers without summoning the parties, and any decision operates for their benefit. It is not a substitute for appealing properly, but it exists.

Specialised circuits

Specialised judicial circuits may be constituted by decision of the relevant judicial authority, including for inheritance matters, with provision for expert assistance. Over time this should mean cases heard by circuits familiar with the subject matter.

The cumulative direction is toward finality and procedural discipline. The record you build at first instance matters more than it did, and deadlines are less forgiving.

07
Protective measures

Acting Before Judgment

A judgment against a defendant with no reachable assets is an expensive piece of paper. Protective steps taken early are often worth more than anything argued later.

  • Precautionary attachment over assets, so that value still exists when judgment arrives. This is frequently the most important application in the whole case and it is time-sensitive.
  • Urgent applications before the summary judge, where a situation cannot wait for the substantive hearing.
  • Travel measures in defined circumstances, which in practice bring a good many defendants to the negotiating table.
  • Preservation of evidence, particularly system and electronic records, before they become unavailable or their authenticity becomes contestable.

Step by step UAE litigation process from limitation to execution
Case process

How a Case Runs

Limitation, first

The limitation position is checked and diarised before anything else is discussed. Periods differ by claim type and several were revised by the new Civil Transactions Law that took effect in June 2026, including for periods that were already running. This is the first thing we look at on any new file and it should be the first thing any lawyer looks at.

Evidence assembly

The documentary record is secured and organised before filing, with attestation and legally certified translation started early. Because there is no disclosure, the case you can prove at the outset is largely the case you will have at the end.

Filing and service

The claim is filed in Arabic with the prescribed fees. The Case Management Office supervises service and the exchange of memoranda. Service problems are a routine cause of delay, particularly against defendants abroad, and should be planned for rather than discovered.

Memoranda

The written argument, exchanged in rounds. This is where the case is actually made. Length is not the objective; a focused memorandum with the documents properly cross-referenced does more than a long one.

The expert stage

As set out above, generally the decisive phase in a commercial matter.

Judgment, appeal and execution

Judgment at first instance, appeal within the statutory period where appropriate and now on stricter formalities, cassation on points of law where the threshold is met, and then execution as a separate stage.

09
Execution

Execution: Where the Money Moves

Winning and recovering are different things, and a surprising number of claimants stop at the first. Execution is its own file with its own procedure, and the measures available include attachment of bank accounts, seizure of assets including shares and vehicles, measures against real property, capture of sums owed to the debtor by third parties, and travel measures in appropriate cases.

Two practical points. Asset identification should begin during the case rather than after judgment, because a defendant who sees judgment coming has time to move value. And where the debtor or the assets sit outside the UAE, or a foreign judgment or award needs to be brought here, that is cross-border work.

Enforcing a foreign judgment or award against UAE assets, and taking a UAE judgment abroad, is handled by our international law firm team.

Onshore litigation compared with arbitration in the UAE
Forum choice

Litigation, Arbitration or Settlement

Where a contract contains a valid arbitration clause the choice has already been made, and filing in court regardless usually ends with the claim stayed or dismissed and the costs wasted. Those matters are run by our arbitration lawyer team. Where no clause exists, the trade-offs look like this:

Onshore litigationArbitration
AvailabilityOpen to any claim within jurisdictionRequires a valid arbitration agreement
LanguageArabicAs the parties agreed
ConfidentialityPublic recordPrivate
Fact-findingCourt-appointed expertAs the tribunal directs
ReviewAppeal and cassation availableVery limited grounds of challenge
Enforcement abroadDepends on treaty and reciprocityNew York Convention framework
Cost profileCourt fee capped at Emirate levelInstitutional and tribunal fees

Settlement deserves a mention of its own. A good proportion of the matters we take end in a negotiated outcome, frequently after a protective measure has changed the commercial picture. That is not a failure of litigation; it is often what litigation is for.

11
Decision point

When to Instruct a Litigation Lawyer in UAE

  • You have been served with a claim, or told that one has been registered against you.
  • A limitation period may be running and nobody has checked where it stands.
  • A counterparty has stopped paying and stopped responding to correspondence.
  • Assets are being moved and a judgment obtained in the ordinary course would arrive too late.
  • An expert has been appointed in a case you are already running and you are not sure how to engage with them.
  • A judgment has gone against you and the appeal window is open.
  • You hold a judgment and nothing has been recovered.
  • You are being asked to sign a settlement drafted by the other side.

Fees & recovery

What Litigation Costs and What You Recover

Three costs sit behind a claim: the court fee, calculated on the claim value and capped at Emirate level; the expert deposit, where an expert is appointed, plus translation and service costs; and legal fees, structured as fixed stage fees, hourly rates or a blend depending on how predictable the matter is.

Recovery of legal costs from the losing party is generally partial, and the amount awarded is often modest relative to what was actually spent. That is why the question worth answering at the start is never simply whether you can win. It is what the realistic net recovery is, against which assets, over what timescale. We give a written view on merits, timeline and recovery prospects before anything is filed, and we will tell you when a claim is not worth bringing.

Why us

Why Clients Choose TrustedLawyers.ae

Choosing the best litigation lawyer in UAE has less to do with courtroom presence, which barely features in this system, than with what gets prepared and when. What we hold ourselves to:

  • The limitation position is checked and diarised on day one, before strategy is discussed.
  • Protective measures are considered at the outset, not once a judgment looks unenforceable.
  • Expert-stage submissions are prepared as the decisive stage, because in most commercial cases that is what they are.
  • Memoranda are written to be read by the court that will read them, in Arabic, with translations we control.
  • Advocates with rights of audience before the courts where your case will actually be heard.
  • The mandate carries through execution and asset tracing, so judgments become recovered money.
  • Settlement is treated as a legitimate outcome and tested at the points where it is most achievable.
  • You are told when a claim is not worth bringing, before you have paid to bring it.

FAQ

Frequently Asked Questions

What does a litigation lawyer do in the UAE?+

Assesses merits and the limitation position, assembles and translates the documentary record, files or answers the claim, drafts the memoranda that carry the argument, manages the court-appointed expert stage, pursues appeals where appropriate and enforces the outcome through the execution court.

Is there disclosure or discovery in UAE litigation?+

No general discovery process exists. Each party produces its own evidence. A court can order production of specific documents essential to the dispute, but broad requests are not permitted. In practice the court-appointed expert is the closest equivalent.

Will there be a trial with witnesses and cross-examination?+

Rarely in the sense most people expect. Proceedings run through written memoranda, hearings are generally short and procedural, and oral testimony is admitted only in defined circumstances. Documentary evidence carries the most weight.

What is a court-appointed expert and why does it matter so much?+

An expert appointed by the court, usually from an official register, to examine the facts and technical issues and report. The report is highly influential and often decides the case in substance. The expert cannot decide legal questions or liability; those remain with the court.

Can I choose the expert?+

Not unilaterally. The court appoints, on its own initiative or on application, generally from the register. Parties can make submissions about scope and about the questions the expert should answer, which is often more valuable than arguing about identity.

Can I challenge an expert report?+

Yes. Parties comment on a draft before the final report is filed, and the report can be challenged before the court afterwards, including by applying for a further expert. Engaging properly at the draft stage is far more effective than objecting once the final report is in.

Is "without prejudice" correspondence protected in the UAE?+

Not in the way common-law lawyers expect. Written communications between parties are generally not privileged and can be relied on. Conduct written settlement discussions on the assumption they may be read by the court.

Do the courts operate in English?+

The onshore courts operate in Arabic and foreign-language documents are filed with legally certified translation. The DIFC and ADGM courts are separate common-law jurisdictions operating in English.

How long does a case take?+

It varies by Emirate, court list, complexity and whether an expert is appointed. Commercial matters at first instance commonly run several months to well over a year, with appeal and execution adding further time. Anyone giving you a fixed figure before seeing your documents is guessing.

What changed in civil procedure in 2026?+

Federal Decree-Law No. 22 of 2025 took effect on 1 January 2026. Appeals must now be filed complete, with grounds and documents, or risk being inadmissible. Cassation review was extended to decisions of the Courts of Appeal as well as judgments. The Public Prosecutor gained a petition power in defined circumstances, and specialised judicial circuits may be constituted.

Can I stop a defendant moving assets before judgment?+

Precautionary attachment is available and is often the most important step in the case. It is time-sensitive, so it should be considered at the outset rather than once a judgment looks difficult to enforce.

Will I recover my legal costs if I win?+

Generally only in part. Awards toward legal costs tend to be modest relative to actual spend, which is why the realistic net recovery, rather than the prospect of winning, should drive the decision to sue.

Should I litigate or arbitrate?+

If your contract has a valid arbitration clause, that usually settles it. Where there is a genuine choice, arbitration offers privacy, language flexibility and stronger international enforcement, while litigation offers appeal rights and a capped court fee. The right answer depends on the counterparty, the assets and where enforcement will happen.

Can you defend as well as claim?+

Yes. A substantial part of our work is defence: challenging jurisdiction, contesting expert findings, attacking quantum and resisting execution.

How do I start?+

Send the contract, the correspondence, any statement of account and anything you have been served with. We come back with the limitation position, the merits, the realistic recovery and what it will cost to act.
