01 — Overview

Personal Injury Lawyer in UAE

TrustedLawyers.ae acts for people injured in road accidents, at work, on premises and through medical treatment that fell below an acceptable standard, and for families in fatal cases. We do this work carefully and without pressure. If your treatment is ongoing and the long-term position is not yet clear, the honest advice is usually to wait before settling, and we will say so even though it delays the file.

The criminal case and the civil compensation claim in a UAE injury matter
Two tracks

Two Tracks, One Accident

Understanding the split is the foundation of everything else on this page.

The criminal or traffic case

Brought by the authorities, not by you. It determines fault and can result in penalties against the responsible party, and it is the route through which diya is claimed in fatal cases. The police report and the traffic file created in the hours after an accident are the primary evidence. If you are the person facing the criminal side of an incident rather than the injured party, that is defence work and sits with our criminal defence lawyer team.

The civil compensation claim

Brought by you, and this is where actual losses are recovered: medical costs, lost income, reduced earning capacity, future care and moral damages. The civil court generally works from the fault position established in the criminal or traffic proceedings and then assesses what is owed.

The practical consequence is that the two need to be run together rather than in sequence. Evidence gathered for the criminal file shapes the civil claim, and decisions taken early in the criminal process, including any settlement, can affect what remains recoverable afterwards.

03
Statutory compensation

Diya and Arsh: Compensation That Works Differently Here

These concepts have no direct equivalent in most legal systems and they cause a great deal of confusion, so it is worth being precise.

Diya

In fatal cases, diya is a fixed statutory sum payable to the heirs of the deceased. It is commonly stated at AED 200,000 across the UAE, and it is applied equally regardless of whether the deceased was male or female. Where a road accident is involved, compulsory third party motor insurance ordinarily responds to it. It is distributed among heirs according to the applicable rules of succession rather than being paid to a single person.

Arsh

Where an injury causes permanent damage or loss of function rather than death, arsh applies. It is calculated as a proportion of diya, set by reference to the nature and severity of the injury, and assessed with the assistance of a court-appointed medical expert.

The point most families are not told

Diya is not the whole entitlement. It is a statutory figure with a fixed value, and it is not designed to reflect what a particular family has lost. A separate civil claim for dependency, medical costs incurred before death, and moral damages can be brought alongside it. Families are frequently told the figure and assume that is the end of the matter. It is not.

How the 2026 UAE Civil Code changed injury compensation
Civil Code

What the New Civil Code Changed in June 2026

Federal Decree-Law No. 25 of 2025, the new Civil Transactions Law, came into force on 1 June 2026 and replaced the 1985 Civil Code. For injury claims it is reported to have made a significant improvement: where diya or arsh does not cover the actual loss suffered, the court can award further compensation to bridge the gap.

If that reading holds, it matters most to exactly the people it should. A catastrophically injured claimant facing a lifetime of care, or a family that has lost its only earner, was previously constrained in a way that bore no relationship to the real loss. The new framework also deals more clearly with contributory fault and the duty to mitigate, which cuts both ways but at least makes the assessment more predictable.

One caution. Which code applies depends on when the incident occurred, and the provision is recent enough that there is limited higher-court authority on how it will be applied in practice. We will tell you what the law provides and what we have seen, and we will not promise an outcome that has not yet been tested.

Compensation

What You Can Actually Claim

There is no tariff. Each head of loss has to be pleaded and proved on evidence, and claims are routinely undervalued because items are simply left out.

  • Medical expenses already incurred, including emergency treatment, surgery, hospital stays, medication and physiotherapy.
  • Future medical and care costs, which for a serious injury is often the largest single figure and the one most often omitted.
  • Loss of income to date, proved through employment records and payslips.
  • Reduced earning capacity, where the injury affects what you can earn going forward. This is distinct from lost income and needs separate evidence.
  • Rehabilitation, assistive equipment, home or vehicle adaptation.
  • Moral damages for pain, suffering and loss of amenity.
  • Dependency in fatal cases, for those who relied on the deceased financially.
  • Property damage arising from the same incident.
  • Diya or arsh where the circumstances give rise to it.

The award depends on the medical evidence, your age, your income, the permanence of the injury and its practical effect on your life. Presenting those properly is most of the work.

Fault apportionment and the police report in UAE accident claims
Fault

Fault, and Why the First Day Matters

Liability for road accidents is fault-based, and the police report is the primary document establishing who was responsible. It is written at the scene, often quickly, sometimes without the injured person being in a position to give an account. It is then very difficult to displace.

Where both parties contributed, fault is apportioned as a percentage and compensation is reduced in proportion. A claimant found twenty per cent responsible recovers eighty per cent of the assessed figure, so the fault allocation is worth as much attention as the quantum.

A report can be challenged, but not by argument alone. What makes the difference is evidence secured immediately: photographs of the scene and vehicle positions, dashcam and CCTV footage before it is overwritten, witness names and contact details, and a medical record created at the time rather than weeks later. If you are able to do only one thing after an accident, preserve the evidence.

Mandatory routes

The Gateway Comes First

Different types of injury have different mandatory routes, and going straight to court in the wrong category means the claim is not accepted.

Injury typeThe required first stepWhat follows
Road accidentPolice report and the traffic fileInsurance claim, then a civil claim where the offer is inadequate
Medical negligenceComplaint to the health authority and referral to a Medical Liability CommitteeA civil compensation claim, which is not accepted before the committee has reported
Workplace injuryNotification to the employer and the applicable MOHRE processStatutory work injury entitlements, and a civil claim where negligence is established
Public or premisesIncident report and evidence gathered at the timeA civil claim against the occupier or operator

Medical negligence

Medical Negligence Claims

Clinical negligence has the strictest gateway of all. Federal Decree-Law No. 4 of 2016 on Medical Liability, with its executive regulation, provides that a compensation claim arising from medical liability is not accepted by a court unless it has first been referred to a Medical Liability Committee. Those committees are convened by the health regulator in the relevant Emirate and have the task of determining whether there was medical error, whether it was gross, causation, and resulting disability.

Two practical points follow. First, you cannot simply sue a hospital and ask a judge to decide whether the treatment was negligent; the committee route comes first. Second, the process runs on short deadlines at each stage, including a limited window to challenge a committee report. Miss it and the report stands, and it will effectively determine the outcome of any subsequent claim.

This is the category where taking advice before starting matters most, because the committee stage is where the case is won or lost and it is not easily revisited.

Workplace injury

Injuries at Work

Workplace injuries sit across two systems. The federal labour framework provides statutory entitlements for work injuries and occupational illness, including medical treatment, wage continuation during recovery and defined compensation for permanent disability or death, calculated by reference to the worker’s wage and subject to a floor and a ceiling. Separately, where the injury resulted from a failure to provide safe working conditions, a civil claim in negligence may be available against the employer, and sometimes against a contractor, occupier or equipment supplier as well.

On construction and industrial sites there are frequently several potentially responsible parties, and identifying them correctly at the outset is what determines whether the claim is worth bringing. Workers should also know that the statutory route and the civil route are not alternatives to be chosen blindly; the interaction between them needs advice.

09
Deadlines

The Clock

Injury claims expire, and several different deadlines run at once.

  • The civil claim. Generally three years from the date you knew of the harm and of the person responsible. It is shorter than many people assume and it does not stop running while you correspond with an insurer.
  • The insurer. Motor insurers are required to decide a claim within a defined period once complete documents are submitted, which is why getting the documentation right the first time matters more than chasing.
  • Medical liability. The committee process has its own reporting and challenge windows, measured in days rather than months.
  • The criminal file. Criminal proceedings have their own limitation rules, separate from the civil claim.

The reason to act early is not only the deadline. Evidence disappears, footage is overwritten, witnesses leave the country and memories fade, and all of that happens long before three years have passed.

Process

How a Claim Runs

  1. Evidence and the gateway
We secure what exists and obtain what is missing: the police or incident report, medical records, footage, witness accounts. Where a mandatory first step applies, that is started immediately.
  2. The medical picture
Independent medical assessment of the injury, the prognosis and any permanent effect. This is the foundation of quantum and it is why settling too early is usually a mistake.
  3. Costing the claim
Every head of loss quantified and evidenced, including the forward-looking items that are easiest to overlook. This is the document that determines what a fair offer looks like.
  4. Negotiation
Most claims resolve without a judgment. A properly evidenced schedule of loss is what moves an insurer, and an early offer made before the medical position is stable is almost always below value.
  5. Proceedings
Where no fair offer is made, the claim is filed. UAE court procedure runs on written memoranda and a court-appointed expert rather than oral trial, and that process is explained on our litigation lawyer page. In injury claims the expert is usually a medical expert, and their assessment carries substantial weight.
  6. Recovery
Judgment is followed by execution where payment is not made voluntarily, so that an award becomes money received.

When to instruct

When to Instruct a Personal Injury Lawyer in UAE

  • You have been injured and the police report does not reflect what actually happened.
  • An insurer has made an offer and you have no way of knowing whether it is reasonable.
  • Your treatment is continuing and the long-term effect on your health or work is not yet clear.
  • A family member has died in an accident and you have been told about diya.
  • You were injured at work and are unsure what your employer owes you.
  • You believe medical treatment fell below an acceptable standard.
  • You have been asked to sign a discharge, settlement or waiver document.
  • Any of the above happened more than a year ago and nothing has been filed.

If you are unsure whether you have a claim at all, ask. An early conversation costs you nothing and it is better than discovering in two years that something recoverable was missed.

Costs & trust

What It Costs

An injury claim carries court fees calculated on the value claimed, medical and expert costs, and legal fees. We give a written view on the likely value, the realistic recovery and the cost of pursuing it before you commit, and where a claim is not worth bringing we will tell you.

A word on fee arrangements. Contingency and no-win-no-fee arrangements as understood in some other countries are not straightforwardly available in the UAE, and any firm implying that you will never pay anything should be asked to put the arrangement in writing and explain exactly what happens if the claim fails. We set out the basis of charging clearly at the outset.

Why Clients Choose TrustedLawyers.ae

Choosing the best personal injury lawyer in UAE is largely about judgement on timing and completeness. What we hold ourselves to:

  • We do not settle a claim before the medical position is stable, because that is how claims get undervalued.
  • Every head of loss is pleaded, including future care and reduced earning capacity.
  • The criminal or traffic file and the civil claim are handled together rather than one after the other.
  • Where a mandatory gateway applies, it is started immediately and run properly.
  • Advice reflects the Civil Code in force since June 2026, including the position on damages beyond diya.
  • Families in fatal cases are told the whole entitlement, not only the statutory figure.
  • You get a realistic valuation, not an optimistic one, and an explanation of how we reached it.
  • The mandate runs through recovery, so an award becomes money actually received.

Frequently Asked Questions

What does a personal injury lawyer do in the UAE?+

Secures and preserves the evidence of fault, handles the mandatory first step for your type of injury, quantifies every head of loss with medical and financial evidence, negotiates with the insurer, brings a civil compensation claim where no fair offer is made, and enforces the award.

What is diya?+

A fixed statutory sum payable to the heirs where a person dies, commonly stated at AED 200,000 in the UAE and applied equally regardless of the gender of the deceased. In road accident cases compulsory third party motor insurance ordinarily responds to it.

Is diya all a family can receive?+

No, and this is the most common misunderstanding. Diya is a fixed statutory figure. A separate civil claim can be brought for dependency, medical costs incurred before death and moral damages, and since June 2026 the court can also award further compensation where diya does not cover the actual loss.

What is arsh?+

Compensation for permanent injury or loss of function, calculated as a proportion of diya by reference to the nature and severity of the injury and assessed with the assistance of a court-appointed medical expert.

How long do I have to bring an injury claim?+

A civil claim is generally subject to a three-year period running from when you knew of the harm and of the person responsible. Other deadlines run alongside it, including insurer response periods and the short windows in the medical liability process, so the position should be checked on your facts.

Does correspondence with an insurer stop the time limit?+

No. Negotiating with an insurer does not stop the limitation clock, and claims are lost this way. If a period is running down, that needs to be managed rather than assumed away.

What if I was partly at fault?+

You can still claim. Fault is apportioned as a percentage and your compensation is reduced in proportion, so establishing the correct allocation is as important as proving the value of the claim.

The police report blames me. Is that final?+

It is influential and difficult to displace, but it is not beyond challenge. Challenging it requires evidence, which is why photographs, footage and witness details secured at the time are so valuable.

Can I claim for medical negligence?+

Yes, but a court will not accept a compensation claim until the matter has been referred to a Medical Liability Committee and the committee has reported. The process runs on short deadlines and the committee stage effectively determines the outcome, so advice before starting is important.

I was injured at work. What am I entitled to?+

Statutory work injury entitlements under the labour framework, including treatment, wage continuation during recovery and defined compensation for permanent disability or death based on wage. Where the injury resulted from unsafe conditions, a separate civil claim may also be available.

Should I accept the insurer’s first offer?+

Not without advice, and usually not before your medical position is stable. An early offer is made when the insurer knows less about the long-term effect than they will later, and it is priced accordingly.

Can I claim for pain and suffering?+

Yes. Moral damages for pain, suffering and loss of amenity are recoverable, alongside financial losses, and they are assessed on the evidence rather than by a fixed tariff.

Do I have to go to court?+

Most claims resolve by negotiation. Proceedings are brought where no fair offer is made. UAE procedure is largely written, and a court-appointed medical expert usually plays the central role rather than a trial with oral evidence.

Is there no-win-no-fee in the UAE?+

Contingency arrangements as understood elsewhere are not straightforwardly available here. Ask any firm to set out the basis of charging in writing, including what happens if the claim does not succeed.

How do I start?+

Send us the police or incident report, your medical records and anything the insurer has sent you, with a short account of what happened. We will come back with an honest view of the claim, the deadlines that apply and what it is realistically worth.
