Divorce Court Lawyer & Attorney in UAE

Divorce Lawyer in UAE

Divorce in the UAE is not one process. It is three, running side by side, and the one your case falls into decides the law that applies to your marriage, the court that hears it, whether you must attend conciliation first, and how your children and your money are treated. People lose ground in UAE family cases far more often through choosing the wrong track at the start than through anything that happens at a hearing.

TrustedLawyers.ae acts for Emiratis and expatriates in divorce, child custody, maintenance and financial settlement matters across the Emirates. We advise on which framework applies to you, prepare and file the case, protect the position on children and support while it runs, and enforce the outcome. The first conversation is always the same one: where you married, where you live now, whether either of you is Muslim, and whether children are involved.

The three divorce legal tracks operating in the UAE compared

Three Divorce Tracks, and Yours Is Decided at the Start

Since 2021 the UAE has built a parallel civil family system alongside the traditional personal status regime. Three frameworks now operate at once, and they are not interchangeable.

The federal personal status track

Federal Decree-Law No. 41 of 2024 replaced the 2005 Personal Status Law and came into force on 15 April 2025. It is the framework where a party is Muslim, and it governs a large part of family litigation in the country. Conciliation through the Family Guidance Section normally comes before the court will register a claim.

The federal civil track for non-Muslims

Federal Decree-Law No. 41 of 2022 on Civil Personal Status, applied from 1 February 2023 and supported by Cabinet Resolution No. 122 of 2023, created a secular family regime for non-Muslim citizens and non-Muslim foreign residents across the country. It provides no-fault divorce on the application of either spouse, treats husband and wife equally, and sets joint custody as the starting point after separation.

The Abu Dhabi civil family regime

Abu Dhabi moved first. Law No. 14 of 2021 on Civil Marriage and its Effects, as amended by Law No. 15 of 2021 and implemented through Chairman Decision No. 8 of 2022, established the Abu Dhabi Civil Family Court for non-Muslim foreigners. It sits with a single judge who may be non-Muslim, runs its forms and procedures in both English and Arabic, and allows divorce on the wish of one spouse without proof of harm.

These systems overlap at the edges, and the edges are where cases are won and lost: mixed-faith marriages, a religious marriage abroad followed by civil residence here, or a spouse who disputes which regime applies. The Abu Dhabi appellate courts have already had to correct lower courts that applied the civil marriage law to parties who were in fact Muslim, which is a useful reminder that eligibility is a legal question, not a preference.

The Right to Ask for Your Home-Country Law

Foreign nationals are not automatically locked into UAE law. Both the personal status framework and the civil framework allow a party, in defined circumstances, to ask the court to apply the law of their nationality instead, provided the result does not conflict with UAE public order.

This is one of the most consequential decisions in an expatriate divorce, and it is made near the beginning. Courts are reluctant to let a party change course once proceedings are running, so the election should be taken as a strategic decision on advice, with the outcomes under each system compared first. Foreign law also has to be proved to the court through properly evidenced and legally translated material, which takes preparation time that people rarely allow for.

It is worth saying plainly that the home-country law is not always the better outcome. Sometimes it is; sometimes the UAE civil framework produces a faster and cleaner result. The point is that the comparison should be made deliberately rather than assumed.

Family Guidance Committee requirements in UAE divorce by legal track

Family Guidance: Compulsory on One Track, Excluded on Another

This is the point most people get wrong, and the misinformation is widespread enough that it is worth stating clearly.

On the personal status track, conciliation comes first. The case is registered with the Family Guidance Section of the relevant judicial department, a court-appointed conciliator works with the spouses, and lawyers do not attend those sessions. Agreements reached here can be recorded and annexed to the judgment. If conciliation does not resolve matters, a referral letter is issued and the court claim follows. In Dubai, the conciliation requirement rests on Dubai Law No. 18 of 2021 on the regulation of conciliation work, as amended by Dubai Law No. 9 of 2025.

On the civil track, it is different. Divorce cases filed under the federal civil personal status framework are expressly excluded from referral to Family Guidance Committees and go directly to the court, and the same direct route applies under the Abu Dhabi civil regime. That is why a civil divorce can move at a pace that surprises people who were told the process always takes months of mediation first.

Being told "everyone has to do mediation" when you are on the civil track costs you weeks. Being told "you can go straight to court" when you are on the personal status track gets your claim refused at registration.

What Changed on 15 April 2025

Federal Decree-Law No. 41 of 2024 made substantive changes that a great deal of online content has still not caught up with. If an article about UAE custody does not mention these, it is out of date:

  • Custody now continues until the child turns 18, for boys and girls alike. The previous rule ended a mother’s custody when a boy turned 11 and a girl turned 13.
  • A child of 15 may express a preference about which parent to live with, and the court weighs it subject to the child’s best interests.
  • Both parents have an equal right to travel with the child for up to 60 days a year, with extensions possible.
  • The minimum age of marriage is set at 18 for both parties, with defined court routes for exceptions.
  • Continuous maintenance is treated as a privileged debt, which matters when the paying party is under financial pressure and other creditors are competing.
  • The period for claiming backdated maintenance was shortened, so delay in bringing a claim now costs more than it used to.
  • Grounds for divorce were revised, including the addition of addiction to intoxicants as a ground.

The law also applies to certain divorce, parentage and related proceedings that had not been finally determined when it came into force, so cases straddling April 2025 need checking against the new provisions rather than the old ones.

Child custody and guardianship rules in the UAE explained

Children: Custody, Guardianship and Travel

Custody and guardianship are separate roles

UAE law distinguishes physical custody, the day-to-day care of the child, from guardianship, the legal authority over the child’s affairs. They are frequently held by different parents, and the 2024 law placed educational guardianship with the mother while general guardianship remains with the father or another guardian, with disputes going before the Judge of Summary Matters. Confusing the two produces claims that ask the court for something it was never going to grant.

Joint custody on the civil track

Under the civil framework, joint custody after separation is the default position rather than something one parent has to fight for. It is still subject to the best interests of the child, and the Dubai courts have been willing to depart from it where the facts require, for example where a parent has relocated abroad. The default sets the starting point; the evidence decides the outcome.

What actually persuades a court

Best interests is not a slogan. In practice it is decided on schooling, stability of housing, who has been doing the daily care, the practical realities of each parent’s work, the child’s own routine, and, from 15, the child’s view. Contemporaneous records are worth far more than assertions made after the dispute has started.

Travel, passports and documents

Child travel is the most common emergency instruction in UAE family practice. The 2024 law addressed the misuse of a child’s identification documents directly, including where documents are used to take a child out of the country against the other parent’s rights, and created consequences for withholding documents from the party entitled to hold them. If you have a genuine and imminent concern about removal, the useful step is a court application, not a further conversation.

08

Maintenance, Mahr and the Fifty-Fifty Myth

There is no automatic community of property

The UAE does not apply a default community property or equitable distribution regime. Assets are not pooled and halved because a marriage ended. Ownership generally follows title and proven contribution, which means the financial outcome depends heavily on documentary evidence: transfers, mortgage payments, funding of a company, remittances and the paper trail behind who paid for what.

This surprises expatriates from jurisdictions where sharing is the starting point, and it is the single largest source of disappointment in UAE financial settlements. A spouse who stepped back from a career and holds nothing in their own name is in a materially different position here than they would be in London or Sydney, and that reality needs to be built into the strategy early rather than discovered at the end.

Maintenance and alimony

Post-divorce maintenance for a former wife and support for children are assessed on the paying party’s means, the length of the marriage and the standard of living established during it, among other factors. Orders can be varied as circumstances change. Under the 2024 law continuous maintenance carries privileged debt status, which strengthens the position where the payer is in financial difficulty.

Mahr on the personal status track

Where a marriage was contracted under the Sharia framework, the dower is a legally enforceable financial obligation, usually split into a prompt portion paid at marriage and a deferred portion falling due on divorce or death. It is a debt in its own right and separate from maintenance, and it is frequently under-claimed because it is treated as a formality rather than an entitlement.

Getting an order paid

A judgment is not money. Where maintenance stops or a settlement is ignored, recovery runs through the execution court using salary attachment, account and asset measures and travel restrictions. That is ordinary civil enforcement work, and our civil court lawyer team runs it alongside the family case rather than treating it as a separate matter.

What makes a prenuptial agreement enforceable in the UAE

Prenuptial and Postnuptial Agreements

Marital agreements are now a genuine planning tool in the UAE, particularly for non-Muslim couples under the civil framework, and the 2024 law expressly recognises written and notarised pre-nuptial and post-nuptial agreements. They are not automatically binding, though, and a document downloaded from abroad and signed at a kitchen table is unlikely to survive.

What courts look for is straightforward: the agreement in writing, properly notarised or attested, legally translated where needed, entered into freely with full financial disclosure on both sides, and not so one-sided as to be unconscionable. It cannot override mandatory protections, and provisions dealing with children remain subject to judicial review in the child’s best interests regardless of what the parties agreed.

For couples with assets across the mainland, the DIFC, the ADGM and one or more foreign countries, the value of the agreement is as much in the coherence it creates across the whole structure as in the document itself.

How a Divorce Case Runs

Establishing the track

Before anything is filed we settle which framework applies, whether a home-country law election should be made, and which Emirate and court has jurisdiction. Getting this wrong is expensive to unwind.

Documents

Marriage certificate, birth certificates, passports and Emirates IDs, and any prenuptial agreement, usually with attestation and legally certified Arabic translation. Foreign documents take time to legalise, and starting this at instruction rather than at the hearing is often what keeps a case on schedule.

Conciliation, where it applies

On the personal status track the matter goes to the Family Guidance Section first. Amicable divorces are frequently concluded at this stage, with a signed settlement recorded before the conciliator. On the civil track this step does not apply.

Filing and hearings

The claim is filed in Arabic before the onshore courts, with translations for foreign-language documents. The Abu Dhabi Civil Family Court operates bilingually in English and Arabic. A civil no-fault divorce may be decided at an early hearing once the other party has been notified, while contested custody and financial matters run longer and may involve expert or social reporting.

Interim protection

While the case runs, urgent applications can secure interim maintenance, regulate contact with children and address travel concerns. These are often more important to the day-to-day reality than the final judgment.

Judgment, appeal and execution

Judgment is followed, where necessary, by appeal within the statutory period, and then by execution. Financial orders are enforced through the execution court, and custody and contact orders have their own enforcement route.

When to instruct a divorce lawyer in UAE — warning signs

When to Instruct a Divorce Lawyer in UAE

  • Separation is being discussed and neither of you has taken advice on which legal track applies.
  • You have been served with papers, or told that a case has been registered against you.
  • You are concerned that your children may be taken out of the country without your consent.
  • Maintenance has stopped and household or school costs are going unpaid.
  • Assets are being sold, transferred or moved out of joint names.
  • Divorce proceedings are running, or about to run, in another country as well.
  • You are being asked to sign a settlement agreement drafted by the other side.
  • An order exists and is simply not being complied with.

One further point that is easier to raise now than later: family breakdown occasionally generates parallel police complaints or criminal allegations. If that happens, it needs handling in step with the family case rather than separately, and our criminal defence lawyer team works alongside the family team where the two overlap.

12

Divorces That Cross Borders

Most family cases in the UAE have a foreign element somewhere: a marriage celebrated abroad, property in another country, a spouse who has already returned home, or a plan to relocate with a child. Three questions usually decide the outcome.

  • Where should the case run? If proceedings are possible in two countries, the choice of forum can change the financial result substantially, and the first filing often shapes what the other jurisdiction is prepared to do.
  • Will the judgment travel? A UAE decree generally needs attestation, legalisation and translation, and then a recognition step in the receiving country before it has practical effect there.
  • What happens to assets and children abroad? Overseas property, offshore accounts and any intended relocation are dealt with inside the case rather than after it, because reopening them later is far harder.

Where a foreign case is already running, the priority is usually speed and coordination between the two sets of advisers, not litigation strategy in isolation.

What a Divorce Costs

Three cost elements sit behind a UAE family case: court fees, which are set at Emirate level and vary by the type of claim; translation, attestation and expert or reporting costs; and legal fees, which can be structured as fixed stage fees or hourly rates depending on how predictable the matter is. The Abu Dhabi civil regime prescribes its own fee for a civil divorce application.

An uncontested civil divorce with no children and no asset dispute is a genuinely modest exercise. A contested case involving custody, cross-border assets and enforcement is not, and it is fairer to say so at the outset. We give a written view on the applicable track, the realistic timeline and the likely cost before you commit to anything, and we will tell you when negotiating a settlement is the better commercial and personal decision than litigating.

Best divorce lawyer in UAE — how TrustedLawyers.ae runs a family file

Why Clients Choose TrustedLawyers.ae

Choosing the best divorce lawyer in UAE is less about who sounds most aggressive than about who gets the early decisions right. What we hold ourselves to:

  • The applicable track and any home-country law election are settled before a claim is filed, because both are difficult to reverse.
  • Advice reflects the law as it stands after 15 April 2025, not the pre-2025 custody and maintenance rules still circulating online.
  • Attestation and legal translation begin at instruction, so documents are never the reason a hearing is adjourned.
  • Children’s arrangements are built around the child’s routine and evidenced properly, not argued from position.
  • Financial claims are supported by the paper trail from the first meeting, because title and contribution decide outcomes here.
  • Advocates with rights of audience before the courts where your case will actually be heard.
  • The mandate carries through execution, so maintenance and settlement terms are actually paid.
  • Discretion as standard. Family matters are handled by a defined team and nothing moves outside it.

Where We Act

We handle family matters across Dubai, Abu Dhabi, Sharjah, Ajman, Umm Al Quwain, Ras Al Khaimah and Fujairah, before the Personal Status Courts and before the Abu Dhabi Civil Family Court. Clients who have already left the country are handled remotely: documents reviewed, attestation and translation arranged, powers of attorney prepared and hearings attended without you needing to travel back.

Frequently Asked Questions

Which divorce law applies to me in the UAE?+

It depends chiefly on whether either spouse is Muslim, on your nationality and residence, and on the Emirate. Federal Decree-Law No. 41 of 2024 governs the personal status track, Federal Decree-Law No. 41 of 2022 provides a civil framework for non-Muslims across the country, and Abu Dhabi operates its own civil family regime under Law No. 14 of 2021 as amended. This should be confirmed on your facts before anything is filed.

Can I get divorced in the UAE without proving fault?+

On the civil track, yes. Either spouse may seek divorce by expressing the wish to end the marriage, without proving harm or assigning blame. The personal status track works differently and grounds are generally pleaded.

Do I have to attend Family Guidance mediation?+

On the personal status track it is normally a precondition to registering the claim. Divorce cases filed under the federal civil personal status framework are expressly excluded from referral to Family Guidance Committees and are heard directly by the court, as is the position under the Abu Dhabi civil regime.

Can I ask the UAE court to apply my home country’s law?+

In defined circumstances, yes, provided the application does not conflict with UAE public order. The election is made at the outset of proceedings and courts are reluctant to allow a change of course afterwards, so it should be a considered decision taken on advice.

Until what age does a mother keep custody?+

Until the child turns 18, for boys and girls alike, under Federal Decree-Law No. 41 of 2024. The earlier rule ending custody at 11 for boys and 13 for girls no longer applies, although a great deal of online material still repeats it.

Can my child choose which parent to live with?+

From the age of 15 the child’s preference is taken into account, subject to the court’s assessment of the child’s best interests.

Is joint custody the norm for expatriates?+

Under the civil framework joint custody is the default starting point after separation. It remains subject to the best interests of the child, and courts will depart from it where the circumstances require, such as where one parent has relocated abroad.

Are assets split fifty-fifty on divorce in the UAE?+

No. The UAE does not apply a default community property regime. Ownership generally follows title and proven contribution, which makes documentary evidence of who paid for what unusually important.

Is a prenuptial agreement enforceable in the UAE?+

It can be. The 2024 law expressly recognises written and notarised marital agreements. In practice enforceability turns on proper form, full financial disclosure, free consent and terms that do not offend public order or mandatory protections. Provisions about children remain subject to judicial review.

How long does a UAE divorce take?+

An uncontested civil divorce can move quickly, and under the civil regimes the court may decide once the other party has been notified. A contested case involving custody, financial claims or cross-border issues takes considerably longer. Any firm quoting you a fixed number of weeks before seeing your documents is guessing.

Can I get divorced here if we married abroad?+

Generally yes, subject to jurisdiction, and the foreign marriage certificate will need attestation and legally certified translation. Where proceedings could also run in the country of marriage, the choice of forum should be considered before filing.

Will my UAE divorce be recognised in my home country?+

Usually, but not automatically. The judgment normally needs attestation, legalisation and translation, followed by a recognition step in the receiving country. Where recognition abroad matters, it is better planned during the case than attempted afterwards.

What can I do if maintenance is not being paid?+

Enforce it. Financial orders are pursued through the execution court, which can attach salary, take measures against accounts and assets and impose travel restrictions. Delay tends to reduce recovery, so enforcement should follow non-payment promptly.

I am worried my spouse will take our children abroad. What can I do?+

Raise it as an urgent application rather than a conversation. The 2024 law deals expressly with the misuse of a child’s identification documents and with withholding documents from the party entitled to hold them, and interim measures are available while the main case is running.

How do I start?+

Send us your marriage certificate, the children’s birth certificates, passport and Emirates ID details and any agreement you have signed. We come back with the track that applies, what it means for children and finances, the likely timeline and the cost.
